Planning

The responsibilities and duties of the Planning Department range from serving as liaison to various commissions and boards to developing and maintaining  plans for renewal projects, land use, historic preservation and housing.
The City of Vicksburg comprehensive plan and zoning ordinance controls the boundaries of the zoning districts in the City of Vicksburg as well as the zoning regulations that are in effect in each district. Zoning districts are designed to protect citizens, their homes, and their businesses from conflicting activities in scope or purpose within the vicinity. For example, you cannot conduct a commercial business in a residential area except under certain conditions. The City of Vicksburg has over 18 distinct zoning districts within its boundaries. The following is a general breakdown of district types:

Residential districts are designed for homes and similar dwellings and to promote family life.

Business districts contain commercial businesses of a non-intensive nature.

Industrial districts allow the operation of larger, more intensive businesses.

Agricultural districts contain mainly undeveloped farm and forest land.

The Historic district preserves the natural or historical environment of an area for recreational, informational, and conservative purposes.

Property owners and developers may request a variance on their land if they feel that a strict application of the City of Vicksburg zoning ordinance would effectively prohibit or unreasonably restrict the use of the property. In such cases, the owner may apply for a variance through the City of Vicksburg Community Planning Department. An zoning application must contain a surveyed plat and a statement of the unusual circumstances or unique physical characteristics which would cause an unreasonable hardship on the applicant under the standard zoning laws. Topographic conditions of the property, such as exceptional narrowness, shallowness, or size are often reasons to request a variance permit. Please note that a variance permit does not represent a special privilege, a change in land use, or a rezoning of the property.

The department recommends that you discuss your situation with a staff member prior to applying for the permit to ease the application process. Once your completed application, necessary plans, and $50.00 application fee have been received, the application will be placed on the Zoning Board of Appeals meeting agenda. You will be contacted with the date and time of your hearing. Hearings are usually held on the first Tuesday of each month at 5:00 PM, in the Board Room of the City Hall Annex, 1415 Walnut Street. Hearings are open to the public. It is strongly recommended that you attend your hearing to answer potential questions or concerns that the Zoning Board may have. After reviewing your application, the committee will either approve your permit request, approve your request pending changes, deny it, or defer a decision.

In the City of Vicksburg, all signage, including temporary signs, requires a sign permit before construction or modification of the element. Additionally, illuminated, neon, or fluorescent signs also require an electrical permit. Zoning ordinances provide different sign standards depending on the zone and linear feet of lot frontage facing the public right of way.

Applicants should be prepared to provide:

The name and address of the property owner and the sign contractor,

A dimensioned site plan that shows the location of all signage and distances from property lines and public right-of-way,

A complete sign description including total number, total square footage, height, material, illumination and copy.

In addition:

Signs shall not be placed in the public right of way, including sidewalks.

Signs shall not physically or visually obstruct or impede pedestrian or vehicular movement.

Signs shall not be placed on any fence, telephone pole, or traffic control
device.

Temporary signs are allowed for no more than 30 days.

Once your completed application, necessary plans, and application fee have been
received, the Community Planning Department will issue the sign permit.

Property in the City of Vicksburg is divided into several various zoning classifications such as agricultural, residential, industrial, or commercial. Some zoning districts allow certain other type land uses that are designated as Special Exception uses. Those certain other type land uses are only permissible if a Special Exception is granted by the City of Vicksburg Community Planning Department and the Zoning Board of Appeals. Approval is based on whether the location, extent and method of development are appropriate and in harmony with the purpose and intent of the ordinance and do not alter the character of the vicinity or interfere with adjacent lots.

Once you have completed an application, submitted the necessary plans and the application fee, the Community Planning Department will place your application on the Zoning Board of Appeals meeting agenda and contact you with the date and time of your hearing. It is strongly recommended that you attend your hearing to answer potential questions or concerns that the Zoning Board may have. After reviewing your application, the committee will either approve your request, approve your request with prescribed conditions and safeguards in conformity with the ordinance, deny it, or defer a decision.

Please note that if a Special Exception is granted by the committee, it does not represent a change in land use or a rezoning of the property.

Land owners and developers wishing to change the classification or district of their property, such as zoning their property located in a residential district for business, must apply through the City of Vicksburg Community Planning Department rezoning process before altering the use of the land. The purpose of the process is to insure that the rezoning measure abides by the comprehensive plan of the City of Vicksburg, avoids incompatible land uses, minimizes the amount of district converted, and serves the interests of the surrounding community.

Before submitting your zoning application, the department recommends meeting with a member of the Community Planning staff to discuss the project. This initial meeting can help you to fill out the application and avert potential pitfalls before they occur. Once your completed application, necessary plans, and application fee has been received, the Community Planning Department will place your application on the meeting agenda for the Planning Commission / Zoning Board of Appeals and contact you with the date and time of your hearing. Hearings are usually held on the first Tuesday of each month at 5:00 p.m. in the Board Room at City Hall Annex,1415 Walnut Street. Hearings are open to the public. After reviewing your application, the committee will recommend to the City of Vicksburg Board of Mayor and Aldermen to either approve your application to rezone, approve a conditional or special use permit, approve your application pending changes, or deny it. Your petition then goes to the Board of Mayor and Aldermen, who have final authority to rule on your request.

If rezoning is recommended to the Mayor and Aldermen, the property will be officially rezoned for its new use after an ordinance is prepared by the applicant and approved by the Mayor and Aldermen.
